THE WEATHER NETWORK “TRIP FOR TWO TO VEGAS” CONTEST Official Rules The Weather Network “Trip for Two to Vegas” Contest (hereinafter “Contest”) is sponsored by Pelmorex Media Inc. c.o.b. “The Weather Network” (hereinafter “Sponsor”). Contest starts on April 25, 2011 at 12:00:01 p.m. (EDT) and closes on June 15, 2011 at 11:59:59 p.m. (EDT) (hereinafter “Contest Period”). Any reference to time in this document indicates Eastern Daylight Time (EDT). ELIGIBILITY 1. Contest is open to anyone who plans or buys media in Canada (hereinafter “Agent”), who is a legal resident of Canada and a minimum of twenty one (21) years of age by the start of the Contest Period. Any Agent involved in the management of the Contest is not eligible to enter or win the Prize in this Contest. Furthermore, employees, representatives and agents (and those with whom they are domiciled) of the Sponsor are also not eligible to enter the Contest or win. HOW TO ENTER 2. Registration 2.1 No purchase necessary to enter or win. Contest is void where prohibited by law. 2.2 To participate in the Contest, log on to the Contest Website at www.theweathernetwork.com/jackpot and complete the electronic Contest entry form (hereinafter “Entry”; collectively, “Entries”) by filling in all required fields and selecting “Submit”. You will then be entered in the Contest. To be eligible, Entries must be received no later than 11:59:59 p.m. on June 15, 2011. The Contest server will be the official time keeper for this Contest. 2.3 Each entrant can only use one (1) e-mail address (validated by name and address) to enter the Contest. One (1) Entry per person/ e-mail address will be accepted during the Contest Period. In the case of multiple Entries, only the first eligible Entry will be considered. 2.5 Chances of winning depend on the total number of eligible Entries received by the end of the Contest Period. WINNER SELECTION 3. From among all eligible Entries received by the server hosting the Contest webpage www.theweathernetwork.com/jackpot, one (1) random draw will be conducted to select one (1) entrant on June 20, 2011 at 3:00:00 p.m. (hereinafter “Selected Entrant”) at the offices of Marketing E.nitiatives located in Whitby, Ontario. 4. Sponsor will contact the Selected Entrant by telephone and/ or e-mail. In the event that the Sponsor, using reasonable efforts, cannot contact the Selected Entrant for whatever reason within five (5) days following the draw, Entrant will be disqualified and another will be chosen by random draw from all eligible Entries submitted. Sponsor will repeat such process, using the same procedure and time periods as described above, as many times as are necessary to contact a Selected Entrant and award the Prize (as hereinafter defined), or until no eligible entrants remain. 5. To be declared the “Winner”, the Selected Entrant will be required to: i) correctly answer, unaided, a time-limited mathematical skill-testing question; and ii) together with his/her guest, complete, sign and return a Declaration of Compliance and a full Liability Release (hereinafter “Form”) that will be sent to both the Selected Entrant and his/her guest by mail, courier, fax, or email. The completed and signed Forms must be returned to Sponsor within fifteen (15) days of receipt. Upon receipt by Sponsor of the completed Forms, the Selected Entrant will be declared the Winner. In the event that the Forms are not signed and returned within the time limit, the Selected Entrant will be disqualified and Sponsor will repeat the process outlined above to choose a new Selected Entrant. 6. Upon receipt of the signed Forms, the Sponsor will contact the Winner by e-mail and/or by phone regarding Prize fulfillment. PRIZE 7. Grand Prize: One (1) Grand Prize is available to be won consisting of a three (3) night/four (4) day trip for two (2) to Las Vegas, Nevada, USA. Grand Prize includes: i) Round trip economy air transportation for two (2) from the major international airport in Canada (Vancouver, Calgary, Saskatoon, Winnipeg, Toronto, Montreal, Halifax) nearest the Winner’s home that flies to Las Vegas, Nevada. ii) Three (3) night’s hotel accommodations (single room; double occupancy) at the New York, New York Hotel & Casio in Las Vegas, Nevada, USA. iii) Five hundred Canadian dollars ($500 CDN) total spending money. iv) One hundred and fifty Canadian dollars ($150 CDN) total spending money for ground transportation to/ from Las Vegas airport and hotel. Approximate Retail Value of Grand Prize package is $3,150 CDN 8. Details of Grand Prize package (hereinafter “Prize), including travel arrangements, accommodations and scheduling will be determined solely by the Sponsor and are subject to change. Exact travel dates and arrangements are subject to availability and blackout periods. Winner is responsible for all incidental costs and expenses not specifically referred to herein, including (without limitation) additional ground transportation, travel and/or medical insurance, meals, airport, gratuities, room service, telephone charges, alcoholic beverages, insurance, entertainment and items of a personal nature. Actual value of Prize depends on point of departure/ destination and airfare fluctuations. Any difference between approximate retail value and the actual value of the Prize as taken will not be awarded. Once the itinerary has been finalized between Winner and Sponsor, no changes can be made unless initiated or approved by Sponsor. In the event that the Winner does not use any portion of the Prize, there will be no extension, transfer, substitution or any kind of compensation provided. Flights do not qualify for loyalty points. Trip must be completed by December 20, 2011 or the Prize will be forfeited in its entirety. 9. Prize Winner and his/her guest are responsible for any travel documents, including a valid passport (or visa, if applicable) and any other applicable travel documents at their own expense and must be eligible for travel within the United States, or the Prize will be forfeited. Other restrictions may apply. Winner and guest will be required to travel on the same itinerary. The Prize Winner’s chosen guest must be 21 years of age at the time Prize is awarded. Contest Sponsor will not be held responsible in the event that the Prize Winner and/or his/her guest are denied entry into the United States or re-entry into Canada. In such an event, the Winner and/or his/her guest will be solely responsible for any and all costs incurred, and the Prize will be forfeited. 10. Prize must be accepted as awarded and cannot be transferred, substituted with another Prize or exchanged in whole or in part for cash or credit except in Sponsor’s sole discretion. Should the Sponsor, for reasons beyond its control and unrelated to the Winner, not be able to award the Prize in the manner described in these rules, the Sponsor reserves the right, at its sole discretion, to award: i) a similar Prize (or a portion of the Prize) of equal value; or ii) the value of the Prize, as indicated in these rules, in cash. GENERAL TERMS AND CONDITIONS 11. By participating in the Contest, each entrant agrees to be bound by these rules. The Sponsor reserves the right, in its sole discretion, to disqualify any entrant found to be: i) violating the Contest or the Contest website, ii) tampering or attempting to tamper with the entry process, or the operation of the Contest or the Contest Website; and/or iii) acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE CONTEST WEBSITE OR ANY RELATED WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVAL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION. 12. The Sponsor reserves the right to reject any Contest Entry that is incomplete, illegible, or mutilated or that contains a human or mechanical error. 13. Any attempt at entering using electronic, computer, or other means which are contrary to the spirit of the Contest or to the Contest rules (e.g., computer pirating, mass emailing, etc.) to enter the Contest will be disqualified. 14. In the event of a dispute regarding a Contest Entry, the Contest Entry will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Selected Entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected Entry. In addition, Selected Entrant may be required to provide proof that he/she is employed as a media buyer or media planner prior to being declared the Winner. 15. In consideration of the Prize or participation in the Prize (as applicable), the Winner and guest authorize the Sponsor, if required, to use their names, photographs, place(es) of residence, voices, images and/or declarations regarding the Prize for advertising and/or publicity purposes without any form of remuneration or further notice. 16. All Entries become the property of the Sponsor. Personal information on Contest Entries will be used only to administer this Contest. If you have consented to use of your personal information by the Sponsor by way of the opt-in on the Contest Entry, the Sponsor may also use your personal information (name, postal code and e-mail address) to provide you with information about its products, services and promotions, and with advertising and marketing material which the Sponsor believes may be of interest to you. By accepting the Prize, Winner and guest agree to release Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and each of their respective directors, officers, employees, and agents, from any and all liability, loss or damage of any kind incurred with respect to participation in this promotion, the awarding, receipt, possession, and/or use or misuse of any prize, or participation in Prize-related activities. The Sponsor, its respective companies, divisions, subsidiaries and affiliates, any other legal person of its corporate group, its affiliated broadcast distributors, advertising and promotional agencies and their respective shareholders, administrators, executives and agents, as well as any contributor to the Contest (collectively, the “Release Recipients”) are not responsible for matters regarding the Prize or the Contest and provide no guarantee for either. Contest entrants agree to indemnify and save harmless the Release Recipients from and against any claims, damages or losses (including legal fees) related to their failure to comply with these Contest rules. 18. The Release Recipients shall not incur any responsibility for incomplete or incomprehensible names and addresses from Contest entrants. The Release Recipients are not responsible for any incorrect or inaccurate information whether caused by Contest Website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the administration of the Contest. The Release Recipients assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of Contest Entries. The Release Recipients are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, on account of technical problems or traffic congestion on the internet, at any website, or on account of any combination of the foregoing. The Release Recipients are not responsible for any injury or damage to entrant or to any computer related or resulting from participating or downloading materials in this Contest. Entrants assume liability for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, or failure to receive any prize. The Release Recipients assume no responsibility or liability in the event that the Contest cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsor, such as infection by computer, virus, bugs, tampering, unauthorized intervention, fraud, technical failures or corruption of the administration, security, fairness, integrity or proper conduct of this Contest, or the Contest Website. 19. In no event shall the Sponsor be held liable where their inability to act results from a fact or situation beyond their control or from a strike, lock-out or any other labour dispute in its facilities or in the facilities of any organizations or companies whose services are used in connection with this Contest. 20. The Sponsor reserves the right to modify or cancel the Contest without advance notice, subject to having obtained any required approval from Quebec’s Régie des alcools, des courses et des jeux. 21. All decisions of the Sponsor in connection with this Contest and the awarding of the Prize are final and without appeal. 22. For Quebec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement. 23. On or about July 11, 2011, the Winner’s name will be available online at www.theweathernetwork.com/jackpot for thirty (30) days; subject to verification by the Sponsor. 25. The Contest and participation therein is governed by and construed in accordance with the laws of the province of Ontario and the laws of Canada applicable therein. 26. Any and all taxes assessed as a result of receiving a Prize will be the responsibility of the Winner. Any other costs in connection with the Prize are the responsibility of the Winner. 27. In case of incompatibility between the English and the French version of the present rules, the English version shall prevail.
